This limited warranty applies only to new garments purchased directly from Truway Health, Inc. or through an authorized Truway Health sales channel and used under normal professional-apparel conditions. Covered Manufacturing Defects Subject to documentation, inspection and approval, this warranty may cover: Manufacturing-related fabric defects Defective stitching or premature seam separation Improperly assembled garment panels Structural defects in the V-neck construction Defective chest-pocket construction Material flaws present upon delivery Missing or defective permanently attached components Significant manufacturing defects that interfere with ordinary professional use Delivery of a size, color or model different from the confirmed order Minor differences in shade, texture, stitching alignment, garment measurements or appearance that fall within normal textile-production tolerances are not considered defects. Available Warranty Remedies For an approved warranty claim, Truway Health may, at its discretion: Repair the affected garment; Replace it with the same product and size when available; Replace it with a substantially equivalent garment; Issue merchandise credit for the verified product value; or Refund the amount paid for the affected scrub top when repair or replacement is not commercially practical. The remedy applies only to the affected garment. Original shipping charges, expedited service fees, embroidery charges, customization costs, duties, taxes, laundering expenses and third-party service charges are excluded unless Truway Health expressly authorizes reimbursement in writing. A replacement garment remains covered for the remainder of the original warranty period or 90 days from the replacement delivery date, whichever is longer. Warranty Exclusions This warranty does not cover damage or performance changes resulting from: Normal wear and tear Gradual fading, pilling, abrasion or fabric softening Improper size selection or personal fit preference Failure to follow the garment care label Excessive heat or high-temperature drying Improper ironing, steaming or pressing Chlorine bleach or unapproved whitening agents Harsh detergents, solvents or cleaning chemicals Biological, pharmaceutical or laboratory chemical exposure Industrial laundering outside approved garment-care parameters Autoclaving, sterilization or high-temperature decontamination Cuts, punctures, burns, snags or accidental tears Damage caused by identification badges, pins or sharp instruments Improper storage, neglect, misuse or abuse Unauthorized alteration, tailoring or repair Screen printing, patches, heat-transfer graphics or third-party decoration Damage caused by an outside laundry, embroidery or alteration provider Contamination that prevents safe inspection or return Products purchased from unauthorized sellers Products without valid proof of purchase Clearance, sample, demonstration, liquidation or final-sale items when identified as such at purchase The garment’s stretch, quick-drying, stain-resistant, anti-static, odor-control, cooling and non-iron properties do not make it immune to permanent staining, chemical damage, abrasion, heat damage or improper laundering. Performance-Fabric Limitation The MOVE performance fabric is designed to support mobility, moisture management and professional comfort under ordinary workplace conditions. Warranty coverage does not guarantee that: The garment will remain completely wrinkle-free All stains will be removable The fabric will prevent perspiration Odor-control performance will remain unchanged indefinitely Stretch recovery will remain unaffected after improper laundering The garment will resist all disinfectants, solvents or chemicals The fabric will provide medical-grade barrier protection Performance characteristics may gradually change through normal wear and repeated laundering. Customization and Embroidery Customized, embroidered or altered garments are generally nonreturnable unless: The base garment contains a covered manufacturing defect; Truway Health supplied the incorrect product; Truway Health produced the customization incorrectly; or Truway Health authorizes the return in writing. The purchaser is responsible for approving: Individual names Professional credentials Facility or department names Organization logos Spelling Thread colors Dimensions Placement instructions Unauthorized third-party customization may void warranty coverage for the altered area and any related damage. Size and Fit Disclaimer Published size charts and body-measurement guidance are provided for product selection and do not guarantee a particular fit. Individual body shape, shoulder width, posture, layering preference and fit expectations may affect suitability. A garment that matches the ordered size is not defective solely because the purchaser prefers a different fit. Warranty Claim Requirements A warranty claim should include: Truway Health order number or invoice Purchaser’s name and contact information Product SKU and selected size Documented delivery date Description of the claimed defect Clear photographs of the full garment Close-up photographs of the affected area Photograph of the product and care labels Information concerning laundering and use Information concerning embroidery or alteration Disclosure of any chemical, biological or hazardous exposure Truway Health may request additional information when necessary to evaluate the claim. Return Authorization Products must not be returned without prior authorization and written shipping instructions from Truway Health. Issuance of a return authorization does not constitute approval of the warranty claim. All claims remain subject to inspection and verification. The purchaser should retain the garment, packaging and supporting documents until return, replacement or disposal instructions are issued. Contaminated Garment Restrictions Garments exposed or potentially exposed to blood, bodily fluids, infectious materials, pharmaceuticals, laboratory chemicals or hazardous substances must not be returned without prior written authorization. The purchaser must disclose all known or suspected contamination before shipping. Truway Health may: Require written confirmation of decontamination; Request photographic evaluation instead of physical return; Direct the purchaser to dispose of the garment; Refuse a garment presenting a health or transportation risk; or Deny a claim when the product cannot be safely inspected. Claim Review and Determination Warranty eligibility is determined after review of the submitted information and, when required, physical inspection. A claim may be denied when the condition is attributable to: Normal wear Improper laundering Excessive heat Chemical exposure Unauthorized alteration Third-party customization Accidental damage Misuse Contamination Fit preference Insufficient documentation Any condition excluded by this warranty Disclaimer of Additional Warranties Except for the express limited warranty stated above, and to the fullest extent permitted by applicable law, Truway Health, Inc. disclaims all other warranties, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, noninfringement and suitability for a specific clinical, laboratory, occupational or institutional application. Some jurisdictions do not permit certain warranty exclusions or limitations. In those jurisdictions, the applicable limitation applies only to the extent permitted by law. Limitation of Liability To the fullest extent permitted by law, Truway Health, Inc., its affiliates, suppliers, officers, employees and distribution partners shall not be liable for indirect, incidental, special, exemplary, punitive or consequential damages arising from the purchase, use, laundering, alteration, contamination, loss or disposal of the garment. Excluded damages may include: Lost revenue or profits Business interruption Replacement staffing costs Uniform-program expenses Laundry or decontamination costs Medical or occupational claims Damage to other clothing or property Loss of contracts Third-party claims Reputational loss Loss of anticipated savings Where liability cannot lawfully be excluded, total aggregate liability shall not exceed the amount paid to Truway Health for the specific garment giving rise to the claim. Consumer and Statutory Rights This limited warranty provides specific contractual rights. Purchasers may have additional rights under applicable state, federal, provincial, national or local law. Nothing in this warranty limits rights that cannot legally be waived, disclaimed or restricted.
