# Limited Product Warranty ## One-Year Truway Health Limited Apparel Warranty Truway Health, Inc. warrants the **Classico R79 Unisex Scrub Canvas Club: SESAME STREET Scrub Top in Dark Green** to the original purchaser against verified defects in materials and workmanship for **one year from the documented delivery date**. Repair the affected garment; 2. Replace it with the same size and product when available; 3. Replace it with a substantially equivalent garment; 4. Issue merchandise credit for the verified product value; or 5. Refund the original amount paid for the affected scrub top when repair or replacement is not commercially practical. The available remedy applies only to the affected garment. Original shipping charges, expedited service fees, embroidery charges, customization fees, duties, taxes, commercial-laundry expenses and third-party service costs are excluded unless Truway Health expressly approves reimbursement in writing. A replacement product remains covered for the remainder of the original warranty term or 90 days from the replacement delivery date, whichever is longer. --- ## Warranty Exclusions This limited warranty does not cover damage or performance changes caused by: * Normal wear and tear * Gradual fading or ordinary color change * Pilling, abrasion, surface friction or fabric softening * Improper size selection or personal fit preference * Failure to follow the garment care label * Excessive heat or high-temperature drying * Improper ironing, steaming or pressing * Ironing directly over embroidery or artwork * Chlorine bleach or unapproved whitening products * Harsh detergents, solvents or cleaning chemicals * Biological, pharmaceutical or laboratory chemical exposure * Industrial laundering not approved for the garment * Autoclaving, sterilization or high-temperature decontamination * Cuts, punctures, burns, snags, tears or accidental damage * Damage from identification badges, pins or sharp instruments * Improper storage, neglect, misuse or abuse * Unauthorized alteration, tailoring or repair * Screen printing, heat-transfer graphics, patches or added artwork * Damage caused by a third-party decorator or laundry provider * Contamination that prevents safe inspection or return * Products purchased from unauthorized sellers * Products without valid proof of purchase * Clearance, sample, demonstration, liquidation or final-sale products when identified as such at purchase The garment’s quick-drying, stain-release, static-control, stretch, no-iron and anti-transparency characteristics do not make it immune to permanent stains, pigments, oils, disinfectants, chemical damage, abrasion or improper laundering. --- ## Licensed Artwork and Embroidery Limitations The R79 scrub top contains licensed SESAME STREET-inspired artwork, embroidery and design details. Warranty coverage may apply when an original licensed design element is materially defective at the time of delivery, including: * Incomplete factory embroidery * Loose embroidery caused by a verified production defect * Missing licensed artwork or trim * Material inconsistency between the delivered garment and the confirmed product Warranty coverage does not apply to: * Gradual fading from normal laundering * Abrasion caused by workplace use * Damage caused by ironing over embroidery * Damage caused by bleach or aggressive chemicals * Unauthorized reproduction or modification of licensed artwork * Added character artwork, patches or third-party decorations * Alterations that affect the licensed design area * Damage caused during unauthorized customization Purchasing the garment does not transfer any copyright, trademark, character, design or merchandising rights to the purchaser. --- ## Optional Personalization and Embroidery Customized, embroidered or altered garments are generally nonreturnable unless: * The base garment contains a covered manufacturing defect; * Truway Health supplied the wrong garment; * The approved customization was produced incorrectly; or * Truway Health expressly authorizes the return in writing. The purchaser is responsible for reviewing and approving: * Names * Professional credentials * Facility names * Department names * Approved organization logos * Spelling * Thread colors * Dimensions * Placement instructions Unauthorized third-party customization may void warranty coverage for the altered area and any related garment damage. Customization must not reproduce, alter, imitate or interfere with protected SESAME STREET characters, artwork or design elements. --- ## Size and Fit Disclaimer Published size charts and body-measurement recommendations are provided as selection guidance and do not guarantee a particular fit. The R79 uses a casual unisex silhouette. Individual body shape, shoulder width, hip measurements, posture, layering preference and fit expectations may affect suitability. A garment that matches the ordered size is not defective solely because the purchaser prefers a different fit. It is not inherently sterile and is not represented or warranted as: * A surgical gown * An isolation gown * A sterile garment * A fluid-resistant barrier garment * A chemical-protective garment * A hazardous-material garment * A flame-resistant garment * A substitute for required personal protective equipment The purchaser and employing organization are responsible for determining whether the garment is appropriate for the intended workplace, clinical activity, infection-control policy, laundry process and occupational-safety requirements. --- ## Warranty Claim Requirements A warranty claim should include: * Truway Health order number or invoice * Purchaser’s name and contact information * Product name and SKU * Selected size * Documented delivery date * Description of the claimed defect * Clear photographs of the complete garment * Close-up photographs of the affected area * Photograph of the product and care labels * Information about laundering and use * Information about embroidery, alteration or customization * Disclosure of any chemical, biological or hazardous exposure Truway Health may request additional information when needed to evaluate the claim. --- ## Return Authorization Products must not be returned without prior authorization and written shipping instructions from Truway Health. Issuance of a return authorization does not constitute approval of the warranty claim. All claims remain subject to documentation review and inspection. The purchaser should retain the garment, packaging and supporting documentation until return or disposal instructions are provided. --- ## Contaminated Garment Restrictions Garments exposed or potentially exposed to blood, bodily fluids, infectious materials, pharmaceuticals, laboratory chemicals, hazardous substances or other contaminants must not be returned without prior written authorization. The purchaser must disclose known or suspected contamination before shipping. Truway Health may: * Require written decontamination confirmation; * Request photographic inspection instead of physical return; * Direct the purchaser to dispose of the garment; * Decline to receive a garment that presents a health or transportation risk; or * Deny a claim when the product cannot be safely evaluated. Truway Health authorization does not replace applicable biological-material, hazardous-material or transportation requirements. --- ## Claim Review and Determination Warranty eligibility is determined after reviewing the submitted documentation and, when required, physically inspecting the garment. A claim may be denied when the reported condition is attributable to: * Normal wear * Improper laundering * Chemical exposure * Excessive heat * Unauthorized alteration * Third-party customization * Accidental damage * Misuse * Contamination * Personal fit preference * Insufficient documentation * A condition otherwise excluded by this warranty --- ## Disclaimer of Additional Warranties Except for the express limited warranty stated above, and to the fullest extent permitted by applicable law, Truway Health, Inc. disclaims all other warranties, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, noninfringement and suitability for a particular clinical, laboratory, occupational or institutional application. Some jurisdictions do not permit certain limitations or exclusions of implied warranties. In those jurisdictions, the applicable provisions apply only to the extent permitted by law. --- ## Limitation of Liability To the fullest extent permitted by law, Truway Health, Inc., its affiliates, suppliers, licensors, officers, employees and distribution partners shall not be liable for indirect, incidental, special, exemplary, punitive or consequential damages arising from the purchase, possession, use, laundering, alteration, contamination, loss or disposal of the garment. Excluded damages may include: * Lost profits or revenue * Business interruption * Replacement staffing costs * Uniform-program expenses * Laundry or decontamination expenses * Medical or occupational claims * Damage to other clothing or property * Loss of contracts * Third-party claims * Reputational loss * Loss of anticipated savings Where liability cannot lawfully be excluded, Truway Health’s total aggregate liability shall not exceed the amount actually paid to Truway Health for the specific garment giving rise to the claim. --- ## Consumer and Statutory Rights This warranty provides specific contractual rights. Purchasers may have additional rights under applicable state, federal, provincial, national or local law.
