Truway Health, Inc. Prepares for Supreme Court Filing Following Dismissal in SDNY and Failure at 2nd Circuit Court of Appeals

New York, NY – November 22, 2024 – Gavin Solomon, President & CEO of Truway Health, Inc., announces the company’s intention to file a new case in the Supreme Court of the United States (SCOTUS) following a dismissal in the Southern District of New York (SDNY) and an unsuccessful appeal in the Second Circuit Court of Appeals in the ongoing legal battle against Texas Woman's University.

The dispute stems from allegations that Texas Woman's University engaged in actions detrimental to Truway Health, violating core constitutional principles and federal protections afforded to corporate entities. The dismissal in SDNY, citing procedural limitations barring corporations from self-representation, has not deterred the commitment to justice. While the appellate court upheld the lower court’s decision, Mr. Solomon asserts that critical constitutional issues remain unaddressed.

“This case is not just about Truway Health—it’s about standing up for corporate rights, constitutional adherence, and due process,” said Gavin Solomon. “The rulings thus far reflect a troubling disregard for procedural justice and the constitutional protections businesses depend on. We are confident that the Supreme Court will recognize the importance of these issues and hear our case.”

Case Background

The litigation arose from alleged breaches of trust and legal obligations by Texas Woman’s University. Truway Health maintains that the university's actions represent a broader failure in upholding constitutional principles. The SDNY court dismissed the case based on procedural grounds, underscoring a requirement for corporate representation by licensed counsel, while leaving substantive issues unresolved.

The appeal to the Second Circuit was met with further procedural obstacles, prompting Truway Health to prepare for a filing with the Supreme Court to ensure that the matter is adjudicated at the highest level of legal authority.

“We respect the judicial process, but it is critical that procedural hurdles not be used to obstruct legitimate claims from receiving fair consideration,” added Solomon. “The constitutional questions at the heart of this case have far-reaching implications for corporations and nonprofit entities across the United States.”

Next Steps

Truway Health will submit a writ of certiorari to SCOTUS, focusing on constitutional violations and the need for a more equitable approach to corporate representation in federal court. The filing will emphasize:

  1. The denial of due process arising from procedural dismissals without addressing substantive claims.
  2. Constitutional questions regarding corporate legal rights and access to justice.
  3. The necessity of SCOTUS intervention to provide clarity and safeguard constitutional protections.
